Terms of Service

Last updated: 17 September 2026

These Terms of Service ("Terms") are a legal agreement between you and Kfami Technologies Private Limited ("Kfami", "we", "us"), and govern your use of the WAH Kfami mobile application and the website at wah.kfami.com (together, the "Service").

By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use the Service

  • The Service is a business tool. You must be at least 18 years old and using it for a business or professional purpose.
  • If you use the Service on behalf of a company or organisation, you confirm that you have authority to bind it to these Terms, and "you" includes that organisation.
  • You must not be barred from using the Service under the laws of India or any other applicable jurisdiction.

2. Your account

  • You must give accurate, complete and current information when you register, and keep it up to date.
  • You are responsible for keeping your password confidential and for all activity under your account, including activity by agents you invite.
  • Tell us straight away at info@kfami.com if you believe your account has been accessed without permission.
  • You may invite team members ("agents") to your account and set their permissions. You are responsible for their conduct and for what they can see and do.
  • We may require identity verification (KYC) before enabling some features, including payments and withdrawals.

3. What the Service does

The Service lets you store customer contacts, send messaging campaigns, and manage customer conversations through the WhatsApp Business Platform, along with a wallet for paying for usage and plans.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app and the Service for your business, in accordance with these Terms. We may add, change, suspend or remove features at any time.

4. Messaging through the WhatsApp Business Platform

Messages you send through the Service are delivered by the WhatsApp Business Platform, operated by Meta Platforms, Inc. By using the messaging features you also agree to, and must comply with:

In particular, you must obtain a recipient's opt-in before messaging them, honour opt-out requests promptly, and use approved message templates where the platform requires them. Meta may limit or block your messaging independently of us, and we are not responsible for messages that Meta delays, rejects or fails to deliver.

Kfami is an independent product. It is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc.

5. Acceptable use

You agree that you will not use the Service, and will not allow your agents to use the Service, to:

  • send spam, unsolicited bulk messages, or messages to people who have not opted in;
  • harass, threaten, abuse, intimidate or defame any person;
  • send content that is unlawful, obscene, pornographic, hateful, discriminatory, or that incites violence;
  • send content that infringes someone else's copyright, trademark, privacy or other rights;
  • run scams, phishing, fraud, pyramid schemes, or deceptive marketing;
  • promote illegal goods or services, including illegal drugs, weapons, or counterfeit products;
  • impersonate any person or organisation, or misrepresent who you are or who you represent;
  • upload contact details you do not have a lawful basis to hold, or use contacts in breach of applicable data protection law;
  • send malware, or attempt to probe, disrupt or gain unauthorised access to the Service, our systems, or other users' accounts;
  • scrape, copy, resell, sublicense or commercially exploit the Service or its content other than as these Terms allow;
  • reverse engineer, decompile or attempt to extract the source code of the app;
  • use the Service in any way that breaches applicable law, including the Information Technology Act, 2000 and the Telecom Commercial Communications Customer Preference Regulations.

6. Content, moderation, reporting and blocking

We have zero tolerance for objectionable content and abusive users. Content that is abusive, harassing, threatening, obscene, hateful, unlawful or otherwise objectionable is not permitted on the Service, and users who send it will be removed. By using the Service you agree to this policy and to the acceptable-use rules in section 5.

6.1 Your content

You retain ownership of the content you create or upload through the Service — messages, templates, contact records, notes and files ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display and process Your Content solely to provide, secure and improve the Service.

You are solely responsible for Your Content and for the messages you send. We do not endorse any content sent or received through the Service.

6.2 Content received from your customers

The Service displays messages and media sent to you by your customers. We do not control that content and are not responsible for it. If you receive content that is abusive, unlawful or otherwise objectionable, you can act on it directly in the app, as described below.

6.3 Reporting objectionable content

In any conversation, you can report a message you consider objectionable by pressing and holding it and choosing Report. Reports are sent to our moderation team with the message and the sender's details. We review every report and will take action we consider appropriate, which may include removing content, restricting a sender, or reporting unlawful content to the authorities.

6.4 Blocking abusive contacts

You can block any contact from a conversation's menu by choosing Block Contact. Blocking removes that contact's conversation from your inbox immediately and notifies our team. You can review and undo blocks at any time under Account → Blocked Contacts.

6.5 Our right to remove content and suspend accounts

We may, without prior notice, remove or disable access to any content, and suspend, restrict or terminate any account or agent, if we reasonably believe it breaches these Terms, the WhatsApp policies referred to above, or applicable law, or if it creates risk or legal exposure for us or other users. Where the law requires, we will act on valid takedown notices and lawful requests from authorities. We are not obliged to monitor content, but we may do so.

7. Your customers' personal data

When you upload or import contact details about other people, you are the data controller for that information and we process it on your behalf as a processor. You are responsible for:

  • having a lawful basis to collect and use those details, including any consent required;
  • giving those people any notice they are entitled to;
  • responding to their requests to access, correct or delete their data; and
  • complying with the Digital Personal Data Protection Act, 2023, and any other data protection law that applies to you.

Our own handling of personal data is described in our Privacy Policy.

8. Plans, wallet and payments

  • Some features require a paid plan or a wallet balance. Current plans and prices are shown in the app.
  • You pay for messaging usage from your wallet. Charges are deducted as messages are sent or as your plan specifies. Usage charges are non-refundable once incurred.
  • Deposits are processed by our payment provider under its own terms. We do not store your full card details.
  • Subscription plans renew as stated at purchase unless cancelled before the renewal date.
  • Withdrawal of an unused wallet balance is available subject to identity verification, a minimum amount, and processing time.
  • All prices are in Indian Rupees and inclusive of applicable taxes unless stated otherwise. You are responsible for any taxes that apply to your use of the Service.
  • Any free trial is for the period and features shown in the app. We may end or change trials at any time.

9. Intellectual property

The Service, including the app, website, software, design, logos and trademarks, is owned by Kfami Technologies Private Limited or its licensors and is protected by intellectual property law. Except for the limited licence in section 3, these Terms give you no right to our intellectual property. "Kfami" and the Kfami logo are our trademarks. You must not use them without our written permission.

If you send us feedback or suggestions, you agree we may use them without any obligation to you.

10. Third-party services

The Service depends on third-party services, including the WhatsApp Business Platform (Meta), Google (Firebase, Google Sign-In), Pusher, and our payment provider. Those services are governed by their own terms. We are not responsible for their availability, performance or actions, and an outage or change on their side may affect the Service.

11. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, security or reasons outside our control. Support is available through the in-app Support Ticket feature and at info@kfami.com.

12. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that messages will be delivered, that the Service will meet your requirements, or that it will be free of errors, viruses or interruptions.

13. Limitation of liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill or data, arising out of or in connection with the Service;
  • our total liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the amount you paid us for the Service in that period;
  • we are not liable for any loss caused by your breach of these Terms, by content sent by you or your customers, or by any third-party service.

Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Kfami Technologies Private Limited and its directors, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of the Service, Your Content, your messaging to third parties, your breach of these Terms, or your breach of any law or third-party right.

15. Suspension and termination

  • By you: you may stop using the Service at any time and request deletion of your account under Account → Delete Account or at wah.kfami.com/delete-account. See our Privacy Policy for what is deleted and what is retained.
  • By us: we may suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, if your account is inactive for 3 months, or if we discontinue the Service.
  • On termination your licence ends and you must stop using the app. Sections that by their nature should survive — including 6.5, 9, 12, 13, 14 and 17 — continue to apply.
  • Any unused wallet balance on termination is handled as described in section 8 and our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above, and for material changes we will notify you in the app or by email before they take effect. Continuing to use the Service after the change takes effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of India. The courts at Gurugram, Haryana have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, subject to any mandatory consumer protection rights you may have.

Before starting formal proceedings, please contact us so we can try to resolve the matter informally.

18. General

  • These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce a right is not a waiver of it.
  • You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets.
  • We are not liable for delay or failure caused by events outside our reasonable control.
